PDF Write Board Terms of Use

These Terms of Use ("Terms") set out the conditions for using the app "PDF Write Board" (including its Android, iOS and web versions; the "App"), provided by ORCA Inc. ("we", "us"). By using the App, you agree to these Terms.

1. License#

Subject to these Terms, we grant you a non-exclusive, non-transferable right to use the App. All copyrights and other rights in the App belong to us or to their rightful owners.

2. Pricing and free trial#

  1. The App is free to download. To keep using features such as writing, you need one of the following:
    • A monthly subscription
    • A yearly subscription
    • A one-time purchase (pay once, no expiry)
    • A license key we issue to an organization
  2. Prices are shown on the store page and in the App's purchase screen.
  3. The App includes a 7-day free trial. You start the trial inside the App; no store sign-up or payment details are needed. When the trial ends, no paid purchase starts automatically. To keep using features such as writing after the trial ends, you need one of the options in paragraph 1.
  4. Subscriptions renew automatically on the same terms unless you cancel at least 24 hours before the end of the current period.

3. Payment, cancellation and refunds#

  1. Payment, cancellation and refunds follow the system and terms of the store where you bought the App (Google Play or the App Store).
  2. To cancel, use your store's subscription settings. Uninstalling the App does not cancel a subscription.
  3. After you cancel, you can keep using the App until the end of the period you paid for. We do not give partial refunds for unused time.
  4. Refunds follow each store's policy. We cannot issue refunds directly.

4. Restoring purchases#

After you change devices or reinstall, use "Restore purchases" in the App to restore what you bought with the same store account. Your files and annotations are not restored (see Section 7).

5. When access ends#

Even after a subscription or trial ends, you can still view your past annotations and export them as images or PDFs.

6. One-time purchases: support period#

One-time purchases and license keys do not expire. However, changes to operating systems, browsers or devices may stop the App from working in the future. We promise to test the App and provide updates for 2 years from your purchase. We plan to keep updating it after that, but we cannot guarantee it.

7. Your data#

  1. The App's data (files, annotations and settings) is stored only on your device. We keep no copies.
  2. If data is lost because you uninstall the App, your device breaks, is lost or is reset, or the App's data is cleared, we cannot recover it. Please export anything important and keep your own copy.

8. Your files#

  1. Open only files (teaching materials, tests, handouts, etc.) that you have the right to use. When you use other people's work in class, follow copyright and other applicable laws.
  2. We are not responsible for the content of the files you open or what you write on them.

10. Disclaimer and limitation of liability#

  1. We do not guarantee that the App works on every device, is free of errors, or fits your purpose. Tested environments are listed in the store description and on our website.
  2. If you suffer damage from using the App, our liability is limited to the amount you paid for the App in the 12 months before the damage occurred, except in cases of our intent or gross negligence.
  3. The previous paragraph does not apply where the law, including Japan's Consumer Contract Act, does not allow us to limit our liability.

11. Changes to the App and end of service#

We may change the App or stop providing it. If we stop providing it, we will announce this in the App or on our website at least 3 months in advance.

12. Organization licenses#

If a license agreement between us and an organization says something different from these Terms, that agreement takes priority.

13. Changes to these Terms#

We may change these Terms in line with the rules on standard terms in the Civil Code of Japan. We will announce the changes and the date they take effect, in the App or on our website, before that date.

14. Governing law and courts#

These Terms are governed by the laws of Japan. The Fukuoka District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the App.
